Notice of Local Special Bond Election

Local Building Authority of Piute County School District, Utah

Public Notice Is Hereby Given that a local special bond election (the “Local Special Election”) will be held by the Local Building Authority of Piute County School District, Utah (the “Authority”) in Piute County School District, Utah (the “District”), at the same time as the regular general election, on Tuesday, November 5, 2024 (“Election Day”).

The Local Special Election will be conducted by mail and ballots will be mailed to all eligible voters beginning the week of October 15, 2024.  Voters can return their ballot by mail, in a secure ballot drop box, or in person for early voting and on Election Day.  The polls for in person early voting shall open at 10:00 a.m. and close at 4:00 p.m. on October 22, 2024 through October 24, 2024 and October 28, 2024 through October 31, 2024 at the Piute County Courthouse, 550 North Main, Junction, Utah 84740.  On Election Day the polls shall open at 7:00 a.m. and shall close at 8:00 p.m. at the Piute County Courthouse, 550 North Main, Junction, Utah 84740.  A secure ballot drop off location where ballots can be deposited during the hours listed below, 7 days a week beginning October 15, 2024 as follows:

The address for the Statewide Election Voter Information Website is vote.utah.gov.  For information on registering to vote and absentee ballots, voters may contact the office of the (a) Piute County Clerk/Auditor (the “County Clerk”) at the Piute County Courthouse, 550 North Main, Junction, Utah 84740, telephone: (435) 577-2840 or visit the County Clerk’s election website at www.piuteutah.com/your-government/elected-officials/clerk-auditor/election-information/, or (b) Utah Lieutenant Governor, State Capitol, 350 N. State Street, Suite 220, Salt Lake City, Utah 84114, (801) 538-1041 or visit the Lieutenant Governor’s website at vote.utah.gov.

For information about alternate times and forms of voting, changes to the location of a polling place and the location of an additional polling place, voters may contact the office of the Piute County Clerk (who is acting as a provider election officer for the Local Special Election) at the Cache County Administration Building at 550 North Main, Junction, Utah 84740, telephone: (435) 577-2840 or visit the County Clerk’s election website at https://www.piuteutah.com/your-government/elected-officials/clerk-auditor/election-information/.

In order to vote in person at the election, you must present valid voter identification to the poll worker before voting, which must be (a) a valid form of photo identification that shows your name and photograph, (b) a valid tribal card, whether or not the card includes your photograph or not, or (c) two different forms of identification that show your name and current address.

There is to be no special registration of voters for the local special bond election, and the official register of voters last made or revised shall constitute the register for the local special bond election, except that all persons who reside within the District (being the geographical area of the Authority) and are registered to vote in the election held on Election Day shall be considered to vote in the local special bond election.

November 5, 2024

Shall the Local Building Authority of Piute County School District, Utah, be authorized to issue lease revenue bonds in an amount not to exceed $6,000,000 and to mature in no more than twenty-six (26) years from the date or dates of issuance of such bonds for the purpose of (a) financing certain costs of acquiring, constructing and improving a portion of (i) the replacement of the Oscarson Elementary School located in Marysvale, Utah and (ii) the replacement of the Circleville Elementary School located in Circleville, Utah (provided that the Authority and the Board of Education of Piute County School District, Utah, may determine to use the proceeds of such bonds to finance only one of the projects in order the limit the security pledged to secure the payment of the bonds with the other project being financed from other sources), (b) if desired, providing capitalized interest to pay the portion of the interest accruing on the bonds during the acquisition, construction and improvement of the projects and (c) paying costs relating to the issuance and sale of the bonds?

To vote in favor of the above bond issue, select the box immediately adjacent to the words “For the Issuance of Bonds.”  To vote against the bond issue, select the box immediately adjacent to the words “Against the Issuance of Bonds.”

Notice Is Further Given that on Thursday, October 10, 2024, at 10:00 p.m., in the Piute County Courthouse, in Junction, Utah, there will be conducted a test of the automatic tabulating equipment or other apparatus to be used to tabulate the results of the November local special bond election to be held in the District on the issuance of $6,000,000 lease revenue bonds of the Authority.  This test is open to public observation in accordance with the provisions of Section 20A-4-104, Utah Code.

Notice Is Further Given that on Tuesday, November 12, 2024, that being a day no sooner than 7 days and not later than 14 days after the local special bond election, the Board of Directors of the Authority (the “Board”) will meet at its regular meeting place at 550 North Main, Junction, Utah, and will canvass the returns and declare the results of the local special bond election during the Board meeting that begins at 3:30 p.m.

Pursuant to applicable provisions of Sections 11-14-208 and 20A-4-403 of the Utah Code, the period allowed for any contest of the local special bond election shall end 40 days after November 12, 2024 (the date on which the results of the election are to be canvassed and the results thereof declared).  No such contest shall be maintained unless a complaint is filed with the Clerk of the Sixth Judicial District Court in and for Piute County, within the prescribed 40-day period.

Public Notice is Hereby Given that on Tuesday, August 13, 2024, the Board of Directors (the “Board”) of the Local Building Authority of Piute County School District, Utah (the “Authority”) adopted a resolution (the “Resolution”), providing for a local special bond election to be held in the Piute County School District, Utah (the “District”), on Tuesday, November 5, 2024, for the purpose of submitting to the qualified electors of the District the question of the issuance of lease revenue in an amount not to exceed $6,000,000 (the “Local Special Bond Election”) and calling a public hearing to receive input from the public with respect to the issuance of lease revenue bonds and the potential economic impact that the improvement, facility, or property for which the bonds pay all or part of the cost will have on the private sector, pursuant to the Section 11-14-318 of the Utah Code Annotated 1953, as amended.

Purpose for the Issuance of Lease Revenue Bonds

If approved by eligible voters at the Local Special Bond Election, the Authority intends to issue lease revenue bonds for the purpose of (a) financing certain costs of acquiring, constructing and improving a portion of (i) the replacement of the Oscarson Elementary School located in Marysvale, Utah and (ii) the replacement of the Circleville Elementary School located in Circleville, Utah (provided that the Authority and the Board of Education of Piute County School District, Utah, may determine to use the proceeds of such bonds to finance only one of the projects in order the limit the security pledged to secure the payment of the bonds with the other project being financed from other sources), (b) if desired, providing capitalized interest to pay the portion of the interest accruing on the bonds during the acquisition, construction and improvement of the projects and (c) paying costs relating to the issuance and sale of the bonds.

Maximum Principal Amount of the Lease Revenue Bonds

If approved by eligible voters at the Local Special Bond Election, the Authority intends to issue lease revenue bonds in an amount not to exceed $6,000,000.

No Taxes Proposed to be Pledged

The bonds will be payable solely from lease payments made by the Board of Education of Piute County School District, Utah.  The Authority has no taxing power.

Time, Place and Location of Public Hearing

The Authority will hold a public hearing during its Board of Directors meeting which begins at approximately 6:00 p.m. on October 2, 2024.  The public hearing will be held in the Piute High School Auditorium, at 550 North 100 West in Junction, Utah.  All members of the public are invited to participate in the public hearing.  Written comments may be submitted to the Authority, to the attention of the Secretary and Treasurer, prior to the public hearing at the offices of the Authority (which are the offices of the Piute County School District) at 500 North Main, PO Box 69, Junction, Utah  84740-0069.  The purpose of the hearing is to receive input from the public with respect to the issuance of the Bonds and the potential economic impact that the Project will have on the private sector.
